1. Acceptance of Terms

By accessing or using iTravas ("the Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our Platform. These Terms constitute a legally binding agreement between you and iTravas.

2. Eligibility

To use iTravas, you must:

Be at least 18 years of age
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Platform under applicable laws
Provide accurate, current, and complete information during registration

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

Provide only truthful and accurate information
Notify us immediately of any unauthorized use of your account
Not share your account credentials with others
Keep your contact information up to date

4. Driver Requirements

To offer rides as a driver on iTravas, you must:

Hold a valid Kenyan driver's license
Have valid vehicle registration and insurance
Maintain a vehicle that meets safety standards
Pass any required background checks or verifications
Comply with all traffic laws and regulations
Accept rides in good faith and complete agreed-upon trips

5. Passenger Responsibilities

As a passenger using iTravas, you agree to:

Be ready for pickup at the scheduled time and location
Treat drivers and other passengers with respect
Pay the agreed fare promptly
Follow safety guidelines and instructions
Not damage the driver's vehicle
Cancel rides only when necessary and with reasonable notice

6. Prohibited Conduct

You may not use the Platform to:

Violate any applicable laws or regulations
Post false, misleading, or fraudulent information
Impersonate any person or entity
Harass, abuse, or harm other users
Engage in discriminatory behavior based on race, gender, religion, or other protected characteristics
Use the Platform for illegal activities, including drug trafficking or other criminal acts
Attempt to circumvent our payment system or fees
Interfere with or disrupt the Platform's operation

7. Payments and Fees

iTravas facilitates payments between drivers and passengers. By using our payment services, you agree to:

Pay all applicable fares and service fees
Provide valid payment information
Not reverse or chargeback payments without valid reason
Understand that iTravas charges a service fee on each transaction
Accept that cancellation fees may apply for late cancellations

8. User Content

You retain ownership of any content you post on the Platform, but you grant iTravas a license to use, display, and distribute such content for the purpose of providing our services. You represent that you have the right to post such content and that it does not violate any third-party rights.

9. Safety and Disclaimer

iTravas is a platform that connects drivers and passengers. We do not provide transportation services directly and are not responsible for the actions of our users. While we implement safety measures, we cannot guarantee:

The safety, conduct, or qualifications of drivers or passengers
The condition or safety of vehicles
The completeness or accuracy of user-provided information
That rides will be completed without incident

You use the Platform at your own risk. We recommend meeting in public places, sharing trip details with friends/family, and trusting your instincts.

10. Insurance

Drivers must maintain valid vehicle insurance as required by Kenyan law. iTravas does not provide insurance coverage for drivers or passengers. Any insurance claims related to rides arranged through our Platform are the responsibility of the parties involved and their respective insurance providers.

11. Limitation of Liability

To the maximum extent permitted by law, iTravas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Platform. Our total liability shall not exceed the amount you paid in service fees in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless iTravas, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

13. Termination

iTravas reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include:

Violation of these Terms
Fraudulent or suspicious activity
Safety concerns
Non-payment of fees
Request by law enforcement or regulatory authorities

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved as follows:

First, through good faith negotiation between the parties
If negotiation fails, through mediation in Nairobi, Kenya
If mediation fails, through binding arbitration in Nairobi, Kenya
These Terms shall be governed by the laws of Kenya

15. Modifications to Terms

iTravas may modify these Terms at any time by posting the revised Terms on the Platform. We will notify users of material changes via email or in-app notification. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

16. General Provisions

These Terms constitute the entire agreement between you and iTravas
Our failure to enforce any right or provision does not constitute a waiver
If any provision is found invalid, the remaining provisions remain in effect
You may not transfer or assign your rights under these Terms
iTravas may assign these Terms without restriction
